Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Snapstuff mobile application (the "App") provided by Side Quest Labs Inc. ("Company," "we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Snapstuff is a mobile application that helps you catalog personal items through photo capture and AI-powered data extraction. The App allows you to:

  • Photograph and catalog items for home inventory purposes
  • Use AI to automatically identify items, estimate values, and extract product details
  • Organize items with labels and custom categories
  • Generate marketplace listings for selling items
  • Export inventory reports

2. Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You may register using email/password or through Apple or Google sign-in.

3. Subscription Plans and Payments

Free Tier

  • 50 AI scans (lifetime limit)
  • Unlimited item storage
  • Full access to all features

Pro Subscription

  • 10,000 AI scans per month
  • Unlimited item storage
  • Priority support

Billing

  • Subscriptions are billed through Apple App Store or Google Play Store
  • Payment is charged to your App Store or Play Store account
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions through your device's App Store or Play Store settings

Refunds

All purchases are processed by Apple or Google. Refund requests must be submitted directly to Apple or Google according to their respective refund policies. We do not process refunds directly.

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following notice of the change.

4. User Content

Your Content

You retain ownership of all photos, data, and other content you upload to the App ("User Content"). By using the App, you grant us a limited, non-exclusive, royalty-free license to:

  • Store and process your User Content to provide the App services
  • Transmit your photos to AI services for analysis
  • Generate and display insights based on your User Content

This license is solely for operating and improving the App. We do not use your User Content for advertising or sell it to third parties.

Content Restrictions

You agree not to upload content that:

  • Infringes intellectual property rights of others
  • Contains illegal material
  • Contains malware or harmful code
  • Violates any applicable law or regulation

Content Removal

We may remove User Content that violates these Terms without prior notice.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's operation
  • Reverse engineer, decompile, or disassemble the App
  • Use automated means to access the App (bots, scrapers, etc.)
  • Circumvent any access or usage limitations
  • Resell, redistribute, or sublicense access to the App
  • Use the App to infringe on others' intellectual property rights
  • Submit false or misleading information
  • Impersonate another person or entity

6. Intellectual Property

Our Rights

The App, including its design, features, and content (excluding User Content), is owned by Side Quest Labs Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation to you.

7. Third-Party Services

The App integrates with third-party services including AI providers, payment processors, and analytics services. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

8. Disclaimers

"AS IS" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI Limitations

AI-generated suggestions, valuations, and identifications are estimates only and may be inaccurate. You should not rely solely on AI-generated information for insurance claims, sales decisions, or other important purposes. We recommend verifying important information independently.

No Professional Advice

The App does not provide professional appraisal, insurance, legal, or financial advice. For accurate valuations or insurance purposes, consult qualified professionals.

Availability

We do not guarantee uninterrupted or error-free operation of the App. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Side Quest Labs Inc. and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Dispute Resolution and Arbitration

Informal Resolution

Before filing a formal dispute, you agree to contact us at support@snapstuff.app to attempt informal resolution. We will try to resolve your concern within 30 days.

Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration will be conducted in English
  • The arbitrator's decision will be final and binding
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found unenforceable, then the entirety of this arbitration provision shall be null and void.

Exceptions

The following disputes are excluded from arbitration:

  • Claims that may be brought in small claims court
  • Disputes related to intellectual property rights

Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@snapstuff.app within 30 days of first accepting these Terms. The notice must include your name, address, and a clear statement that you wish to opt out.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Delaware.

13. Termination

By You

You may terminate your account at any time by contacting us at support@snapstuff.app. Upon termination, your right to use the App ceases immediately.

By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Create liability or legal risk for us

We may also discontinue the App at any time with reasonable notice.

Effect of Termination

Upon termination:

  • Your license to use the App ends
  • We will delete your account data within 30 days unless legally required to retain it
  • Sections that by their nature should survive (limitations of liability, indemnification, dispute resolution) will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Sending an email for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and Side Quest Labs Inc. regarding the App.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.
